Detailed statutory analysis & overview

The gap between an ABN contract rate and an equivalent salary in Australia is wider than most people assume, because an employment package silently carries the Superannuation Guarantee, four weeks of annual leave, ten days of personal leave, public holidays, workers compensation cover, and payroll tax borne by the employer. The Superannuation Guarantee reached 12% of ordinary time earnings from 1 July 2025, the final step of the legislated increase, which alone widens the gap that a contract rate must close. Two Australia-specific traps then complicate the picture. First, superannuation can follow you anyway: under section 12(3) of the Superannuation Guarantee (Administration) Act, a person engaged under a contract wholly or principally for their labour is a deemed employee for super purposes, so a hirer may be obliged to pay 12% on top of your invoices regardless of the ABN. Second, the personal services income rules can strip out your deductions and attribute income straight back to you if you fail the relevant tests. This tool prices those effects into a defensible day rate.

Key Regulatory Parameters & Frameworks (YA 2026)

Rule 01

Superannuation Guarantee at 12%

Employers must contribute 12% of ordinary time earnings to a complying super fund from 1 July 2025, the end point of the phased rise from 9.5%. Contributions are due quarterly, and payday super reforms are scheduled to move this to payment at the same time as salary. A maximum contribution base caps the quarterly earnings on which SG is compulsory for very high earners.

Rule 02

Deemed Employee for Super Purposes

Section 12(3) of the SGAA extends the super obligation to anyone working under a contract that is wholly or principally for their labour, where they are paid for their personal effort rather than to produce a result and cannot delegate the work to someone else. Many one-person ABN consultants fall inside this, meaning the client owes 12% super on the labour component of the invoice in addition to the fee. Getting this wrong exposes the hirer to the superannuation guarantee charge, which is not tax deductible and includes interest and an administration component.

Rule 03

Personal Services Income Rules

If more than 50% of the income from a contract is a reward for your personal skills or effort, it is personal services income. You escape the restrictive PSI regime only by passing the results test, or, where fewer than 80% of your PSI comes from one client, one of the unrelated clients, employment, or business premises tests. Failing them means deductions such as rent for your home, payments to an associate, and certain vehicle costs are denied, and income earned through a company or trust is attributed back to you personally.

Rule 04

GST Registration and BAS

Registration is compulsory once GST turnover reaches AUD 75,000 in a 12-month period, tested on a forward-looking as well as backward-looking basis. Registered contractors charge 10% GST, claim input tax credits on business purchases, and lodge a business activity statement, generally quarterly. Registering below the threshold is optional and mainly worthwhile if you have significant GST-inclusive costs, since business clients simply reclaim the GST you charge them.

Rule 05

PAYG Instalments and Sham Contracting

Contractors have no PAYG withholding, so the ATO puts you into the PAYG instalment system after your first return with business income, requiring quarterly prepayments against the coming year's liability. Separately, the Fair Work Act prohibits sham contracting, that is misrepresenting an employment relationship as an independent contract. Following the High Court decisions in Personnel Contracting and Jamsek, characterisation turns primarily on the rights and obligations in a comprehensive written contract rather than on how the relationship played out day to day, though later Fair Work amendments reintroduced a broader consideration of the real substance and practical reality of the relationship.

ABN Contractor vs. Employee on an AUD 120,000 Package

Scenario Context: Comparing a total employment package of AUD 120,000 inclusive of super against an ABN contract, for a full-time-equivalent engagement in the 2025-26 year.

Calculation StageComputed Value
Employee base salary within a AUD 120,000 packageApproximately AUD 107,143 plus 12% SG of about AUD 12,857
Paid leave value (4 weeks annual + 10 days personal + public holidays)Roughly 30 non-worked days, about 12% of the working year
Employer-borne costs the contractor absorbsWorkers compensation, payroll tax, professional indemnity and public liability insurance, income protection
Contractor billable daysAround 220 after leave, public holidays, illness, and unbilled admin time
Required contract rate to matchRoughly AUD 640 to AUD 700 per billable day, before GST
Final Deducted Result:An ABN contractor generally needs to charge 20% to 30% above the equivalent salary to stand still once the 12% Superannuation Guarantee, unpaid leave, insurances, and non-billable time are funded. Where the engagement is wholly or principally for labour, the client may owe the 12% super separately under section 12(3), which materially changes the comparison and is worth confirming in writing before signing.

Frequently Asked Questions (FAQ)

Is GST registration required for ABN contractors?▼

You must register once your GST turnover reaches AUD 75,000 in any rolling 12-month period, or immediately if you expect to reach it. Below the threshold registration is voluntary. Registering lets you claim input tax credits on business expenses, and because business clients reclaim the GST you charge, the extra 10% on your invoices usually costs them nothing, so most full-time contractors register regardless.

Does my client have to pay super even though I invoice through an ABN?▼

Possibly. Section 12(3) of the SGAA deems you an employee for super where the contract is wholly or principally for your labour, you are paid for personal effort rather than a specified result, and you cannot subcontract the work. Having an ABN does not override this. Contracting through your own company usually takes the arrangement outside section 12(3), which is one reason hirers often insist on a company structure, but that brings the PSI rules into play instead.

What are the PSI rules and do they apply to me?▼

Personal services income rules apply where more than half of a contract's income rewards your personal skills. The cleanest escape is the results test: you are paid to produce a specified result, you supply your own tools, and you are liable to rectify defects at your own cost. Otherwise, if 80% or more of your PSI comes from a single client you are automatically in the PSI regime; below 80% you can instead pass the unrelated clients, employment, or business premises test. Inside the regime, deductions are restricted and income routed through a company or trust is attributed back to you.

How should I set aside money for tax as a contractor?▼

There is no withholding, so you carry the whole liability yourself. A common approach is to move 30% to 35% of every invoice into a separate account for income tax and Medicare levy, plus the GST component if registered, plus at least 12% of your labour component for your own super, which is deductible as a personal concessional contribution within the annual cap. Once the ATO issues PAYG instalments you will be paying quarterly in advance, which smooths the cash flow but does not reduce the total.
