Detailed statutory analysis & overview

Section 44ADA is the single most valuable provision in Indian tax law for an independent professional, and most people misstate its limits. It allows a resident individual carrying on a profession specified under section 44AA(1) to declare 50% of gross receipts as taxable income with no bookkeeping and no audit, and the receipts ceiling is INR 50 lakh, extended to INR 75 lakh only where cash receipts do not exceed 5% of turnover, which for anyone billing by bank transfer is easy to satisfy. The professions covered are specified rather than general: legal, medical, engineering, architectural, accountancy, technical consultancy, interior decoration, and others the Board has notified, including film artists and authorised representatives. Against that benefit sit obligations an employee never sees. Clients deduct TDS under section 194J before paying you, you must pay advance tax yourself rather than rely on payroll withholding, and once service turnover crosses the GST threshold you register, file returns, and either charge GST domestically or export under a letter of undertaking. This tool models presumptive taxation, TDS credit, and the GST position together.

Key Regulatory Parameters & Frameworks (YA 2026)

Rule 01

Section 44ADA and Its Real Thresholds

A resident individual, Hindu undivided family, or partnership firm other than an LLP carrying on a profession specified in section 44AA(1) may declare 50% of gross receipts as profits. The limit is INR 50,00,000 of gross receipts, raised to INR 75,00,000 where receipts in cash do not exceed 5% of total receipts, with receipts through banking channels excluded from the cash test. No further deduction for business expenses or depreciation is allowed, books need not be maintained under section 44AA, and no audit is required under section 44AB.

Rule 02

TDS Under Section 194J

A client deducts tax at source on fees for professional services at 10%, or 2% for fees for technical services and for certain payments to persons engaged in the business of call centres. The annual threshold below which no deduction is required was raised from INR 30,000 to INR 50,000 per category of payment. The deduction is a credit, not a cost: it appears in your Form 26AS and Annual Information Statement and is set against your final liability, frequently producing a refund where you are on presumptive taxation.

Rule 03

Advance Tax and the 44ADA Concession

Without payroll withholding, the liability is yours to fund. Ordinary taxpayers pay advance tax in four instalments by 15 June, 15 September, 15 December, and 15 March at cumulative rates of 15%, 45%, 75%, and 100%, with interest under sections 234B and 234C for shortfall and deferment. Taxpayers declaring income under section 44ADA get a simplification: the entire advance tax may be paid in a single instalment by 15 March, which removes the quarterly forecasting burden entirely.

Rule 04

GST Registration and Export of Services

Registration is compulsory once aggregate turnover from services exceeds INR 20 lakh, reduced to INR 10 lakh for the special category states. Domestic supplies are then taxed at the applicable rate with monthly or quarterly GSTR-1 and GSTR-3B filings. Services supplied to a recipient outside India and paid for in convertible foreign exchange qualify as zero-rated exports, which can be made either under a letter of undertaking without payment of tax, or on payment of IGST with a subsequent refund claim. The letter of undertaking route is the usual choice for freelancers billing overseas.

Rule 05

What You Give Up Relative to Employment

Independent professionals fall outside the Employees' Provident Funds Act, so there is no employer provident fund contribution and no Employees' Pension Scheme accrual, and outside the Payment of Gratuity Act, so no gratuity accrues at fifteen days of basic pay per year. There is no Employees' State Insurance cover, no paid leave, and no statutory notice period. The available substitutes are the National Pension System, which remains deductible in limited form, the Public Provident Fund, and private health and income protection cover, all self-funded.

Presumptive Taxation on INR 40 Lakh of Professional Receipts

Scenario Context: Resident freelance software engineer for FY 2025-26 with INR 40,00,000 of gross professional receipts, all received through banking channels, declaring under section 44ADA and taxed under the default new regime.

Calculation StageComputed Value
Gross professional receiptsINR 40,00,000, within the INR 75,00,000 ceiling since cash receipts are nil
Deemed professional income at 50% under section 44ADAINR 20,00,000, with no further deduction for expenses or depreciation
Slab tax under the new regime on INR 20,00,000INR 20,000 at 5%, INR 40,000 at 10%, INR 60,000 at 15%, and INR 80,000 at 20%, totalling INR 2,00,000
Section 87A rebateNot available, as income exceeds INR 12,00,000
Health and education cess at 4%INR 8,000
Total tax liabilityINR 2,08,000
TDS already deducted by clients under section 194J at 10%INR 4,00,000, credited against the liability
Advance tax positionPayable in a single instalment by 15 March under the section 44ADA concession
Final Deducted Result:A liability of INR 2,08,000 on INR 40,00,000 of receipts, an effective rate of 5.2% on gross, because only half the receipts enter the computation and the standard deduction does not apply to professional income. Since clients deducted INR 4,00,000 of TDS, the filing produces a refund of roughly INR 1,92,000, which is the normal pattern for a presumptive professional and a strong argument for filing promptly rather than late.

Frequently Asked Questions (FAQ)

Do freelancers need GST registration?▼

Registration becomes compulsory once aggregate turnover from services exceeds INR 20 lakh in a financial year, or INR 10 lakh for the special category states. Aggregate turnover is computed across all your supplies on the same PAN, including exempt and export supplies, so exports count toward the threshold even though they are zero-rated. Below the threshold registration is voluntary, and it is often taken up anyway because Indian business clients prefer a registered vendor who can issue a tax invoice.

Can I claim 44ADA if my receipts are INR 60 lakh?▼

Yes, provided cash receipts do not exceed 5% of your total receipts. The base limit is INR 50 lakh, and it extends to INR 75 lakh only where that cash condition is met, with amounts received through banking channels and prescribed electronic modes excluded from the cash test. A freelancer paid entirely by bank transfer or foreign remittance therefore has the full INR 75 lakh available, while one taking meaningful cash payments is confined to INR 50 lakh.

What happens if my actual profit is more than 50%?▼

Nothing adverse, and that is the point of the provision. Section 44ADA deems your income to be 50% of gross receipts regardless of actual profitability, so a consultant with minimal costs and an 85% real margin is taxed on half. The converse is the risk: if your genuine profit is below 50% and you want to declare the lower figure, you must maintain books under section 44AA and obtain an audit under section 44AB, and having opted out you face restrictions on returning to the presumptive scheme.

How do I get my TDS back if too much was deducted?▼

By filing a return and claiming the credit. Section 194J deduction at 10% applies to gross fees, while presumptive taxation charges only half of those fees, so over-deduction is structural rather than exceptional. Verify the credit appears in Form 26AS and your Annual Information Statement before filing, since the credit follows what the client actually deposited against your PAN. Where you expect a persistent shortfall you can also apply under section 197 for a certificate authorising deduction at a lower rate.
